In a significant international legal development, Italian Prime Minister Giorgia Meloni announced that a formal complaint has been filed against her and senior cabinet members at the International Criminal Court (ICC) in The Hague. The complaint alleges “complicity in genocide” regarding the ongoing Israeli conflict in the Gaza Strip.
Legal Basis and Key Accusations The complaint filed with the Office of the Prosecutor also targets Defense Minister Guido Crosetto and Foreign Minister Antonio Tajani. Unlike state referrals, this is a direct denouncement by a group of 50 international law experts and activists, invoking Articles 14 and 15 of the Rome Statute.
- Core Charge: The legal action rests on Article 25 of the Rome Statute, concerning individual criminal responsibility. It alleges that Italy’s continued supply of military equipment makes the government a facilitator of “war crimes and crimes against humanity.”
Italian Government’s Defense Prime Minister Meloni expressed “surprise” at the allegations. The government maintains that it has not authorized any new arms sales to Israel since October. However, activists argue that honoring pre-existing military contracts still facilitates the ongoing operations, maintaining immense political pressure on Rome’s right-wing administration.
